(1) If any of the following acts are committed, it shall be considered as having committed the following crimes:-
(a) Offenses relating to unauthorized entry: No aircraft enters Nepal without obtaining permission in accordance with this Act or prevailing laws (b) Crime related to airspace encroachment: If an aircraft overflys the territory of Nepal without obtaining a permit in accordance with the prevailing law, it will be deemed to have committed a crime related to airspace encroachment.
(c) Crime of illegal seizure and hijacking of an aircraft: If someone takes possession or control over an aircraft by unlawfully using force or threatening to use force or showing any other form of fear, the crime of illegal seizure and hijacking of an aircraft is committed. will be considered.
(d) Crime against the safety of air flight: If any of the following acts are committed, it will be considered as a crime against the safety of air flight:- If violent action is taken against any person inside the aircraft in flight or if such action is likely to endanger the safety of the aircraft, destroying the aircraft operating in the 9D0 service. If such aircraft is disabled for flight or if it is damaged beyond the possibility of endangering its safety in flight, 9.0 ground aircraft or parts or equipment attached to the aircraft or air transport related facilities (facilities) or communication aviation support equipment or fire prevention or life saving services and safety equipment. or in case of destruction or damage to related goods or objects etc. or in unauthorized removal of any part or parts thereof or in the event of interference in its operation, 9.0 In case of communicating any information known to be false and causing danger to the safety of the aircraft in flight.
(e) Offense against the safety of aircraft: By any means, any device or object is placed or caused to be placed on an aircraft in service or on the ground, in accordance with sub-section (2) of clause (d), causing the aircraft to be destroyed or rendered incapable of flight or If the flight is likely to endanger its safety orIt will be considered a crime against Yuan's security.
(f) Crimes against airport security: Communication and aviation aids, visual aids, weather and climate related devices, fire prevention and life saving service related devices and devices, other security related devices and devices located inside or outside the airport and airport area. and other devices, equipment, buildings, runways, taxiways, aprons, hangars, etc., directly or indirectly related to air flight, etc. If it is demolished, damaged or destroyed, it will be considered a crime against airport security.
(g) Crimes against the safety of persons related to air transport: Abduction of any employee related to air flight operations, government or non-government employees working at the airport, any person visiting the airport including air passengers, with or without arms, by fear, threat, enticement or by any other means. If he deviates from his duty by taking possession of it or causing danger or hindrance to air flight operation and safety in any other way, he will be considered to have committed a crime against the safety of the person related to air transport.
(2) Committing a crime under clauses (c), (d), (e), (f) and (g) of sub-section (1), being intoxicated in committing such crime or committing a crime shall also be considered as an offense under this section. br> (3) Those who commit the following crimes mentioned in sub-section (1) shall be punished as follows:-
(a) Those who commit crimes under clauses (a) and (b) shall be imprisoned for one to three years.
(b) Those who commit crimes under clauses (c), (d) and (e) shall be imprisoned for life and those who engage in such crimes or become drunkards shall be imprisoned for fifteen to twenty years.
(c) He shall be imprisoned from one year to five years after paying the damages caused by the person who commits the crime under Clause (f).
(d) Whoever commits the crime under Clause (g) shall be imprisoned for five years to ten years.
(e) anything in the foregoing sectionsEven though it is written, if any person in the aircraft dies as a result of committing such a crime or if the aircraft itself is destroyed, the perpetrator will be imprisoned for life and the offender will be imprisoned for life or fifteen to twenty years and the property of the offender and the offender will also be confiscated.
